Cagayan governor Mamba diskwalipikado –Comelec

DINISKWALIPIKA ng Commission on Elections (Comelec) si Cagayan Governor Manuel Mamba kaugnay sa 2022 national elections.

Ito ay bunsod ng mga paglabag umano ni Mamba sa Omnibus Election Code na nagbabawal sa pagpapalabas ng public funds para sa lahat ng public works mula Marso 25, 2022 hanggang Mayo 8, 2022, ayon sa desisyon na inilaban ng Comelec First Division.

Dahil dito, idineklara ng Comelec ang posisyon ng Cagayan governor na bakante, at otomatikong mauupo ang vice governor ng lalawigan base na rin sa law of succession.

Sa pahayag, sinabi ng Comelec na “Mamba is incorrect in claiming that the prohibition does not extend to local government units.”

“This prohibition aims to prevent the use of public funds for campaign purposes, and it serves a deterrent effect on incumbent public officials having control and access to public funds from using the same in furtherance of their own political interests.”

“Furthermore, the ban clearly covers ongoing infrastructure programs. Section 2 of Resolution No. 10747 enumerates the programs, projects and activities (PPAs) which are exempt from the ban, and ongoing social welfare projects are not included in the list. No Certificate of Exemption was secured from the Comelec for the continued implementation of the subject PPAs during the 45-day prohibition period,” dagdag pa ng desisyon.

Nag-ugat ang diskwalipikasyon base sa isinampang reklamo ni Victorio Casauay laban kay Mamba, Mabel Mamba at Francisco Mamba III bilang mga kandidato sa governor, vice governor at representative ng ikatlong distrito ng Cagayan noong 2022 elections.

Sa kanyang petisyon, sinabi ni Casauay na ginamit ng mga ito ang pera ng gobyerno sa pagbibigay ng ayuda, scholarship grants at transport vehicles sa kanilang constituents noong kasagsagan ng election period.
