Frustrated homicide vs driver na sumagasa sa sekyu

SASAMPAHAN ng kasong frustrated homicide ng Mandaluyong City prosecutors’ office ang driver na si Jose Antonio Sanvicente, na sumagasa sa security guard noong Hunyo.

Sa resolusyon na ibinaba nitong Hunyo 29, nakakita ng probable cause ang mga prosecutors para kasuhan si Sanvicente na sumagasa at nag-abandona sa security guard na si Christian Joseph Floralde.

Una nang sinampahan ng reklamo ni Floralde si Sanvicente ng frustrated murder at pag-abandona sa kanya o paglabag sa Article 275 ng Revised Penal Code.

Sa resolusyon, ibinasura ng prosecutor ang reklamong abandonment dahil sa kakulangan umano ng ebidensiya.

Matatandaan na nagmamando ng trapiko si Floralde sa isang kalye na malapit sa isang mall sa Mandaluyong City, nang mabundol siya ni Sanvicente. Imbes na huminto at tulungan ang biktima ay ginulungan pa ng sasakyan na minamaneho ng suspek ang biktima at tumakas.

“It would not be amiss to state that respondent neither reduced velocity, halted, nor changed direction after complainant was pinned by his vehicle. Respondent did not even express any regard for complainant by stopping his vehicle and/or alighting therefrom to check on the victim. Worse, respondent impertinently sped away as if nothing happened and without due concern that he could still run over complainant with his rear tires,” ayon sa resolusyon.

“Having established intent to kill, sufficient cause therefore exists to indict respondent for Frustrated Homicide.”

Paliwanag naman ng prosecutor na ibinasura ang complaint para sa violation of Article 275 (2) dahil sa “diametrically opposed” sa findings ng frustrated homicide.

“Anent, the charge for violation of paragraph (2) of Article 275 of the Revised Penal Code, this Office finds the same diametrically opposed if not congruent to the findings of Frustrated Homicide. Evidently, respondent’s intent to eliminate complainant negates any regard to save or aid his ailing victim,” dagdag pa nito.
