IBINASURA ng Sandiganbayan ang petisyon ni dating Health Secretary at ngayon ay Iloilo Rep. (1st District) Janette Garin na i-dismiss ang kasong graft na isinampa sa kanya kaugnay sa kontrobersyal na Dengvaxia vaccine.
Sa isang 9-pahinang resolusyon, hindi rin pinayagan ng Sandiganbayan Second Division na mabasura ang kaso laban sa mga kasamahan ni Garin na sina dating DOH Undersecretaries Gerardo Bayugo, Kenneth Hartigan-Go, dating DOH Officer-in-Charge Director Maria Joyce Ducusin at dating Philippine Children’s Medical Center Executive Director Julius Lecciones.
Nahaharap si Garin at mga dating opisyal ng DOH sa kasong graft dahil sa diumano’y pakikipagkutsabahan para mai-realign ang pondo ng gobyerno na nagkakahalaga ng P3.5 bilyon para sa pagbili ng Dengvaxia vaccine noong 2015 na ginamit para sa School-Based Immunization Program.
Sa petisyon ng mga akusado, nalabag umao ang kanilang mga karapatan para sa “speedy disposition of cases” na hindi naman sinang-ayunan ng korte.
“(T)he Court finds that the length of time spent by both the DOJ (Department of Justice) and the Office of the Ombudsman before issuing the resolutions that culminated in the filing of the cases in court is reasonable and acceptable,” ayon sa resolusyon ng korte.
“(T)he investigations were not attended by vexatious, capricious and oppressive delays. Rather, the length of time spent in the investigation indicates that a careful examination and review of the evidence and documents were thoroughly undertaken before the cases were filed in court.”
Giit ni Garin at ng iba pang mga akusado na inosente sila sa mga akusasyong ibinabato sa kanila.
