Court junks Sandro Muhlach’s acts of lasciviousness case

THE Pasay City Metropolitan Trial Court has dismissed the acts of lasciviousness case filed by Sandro Muhlach against GMA-7 independent contractors Jojo Nones and Richard Cruz.

In its ruling, the Pasay MTC Branch 46 granted Nones and Cruz’s motion to quash the charges, stating that the allegations are already covered under the rape through sexual assault case filed by the Department of Justice in the Pasay Regional Trial Court.

The court called the filing of separate acts of lasciviousness cases an “overkill.”

“The acts of lasciviousness before this court are necessarily included in the charge of rape before the Regional Trial Court,” the court said, adding that the prosecution’s move was redundant and absorbed within the primary case. 

Muhlach’s camp has yet to issue a statement on the decision.
