PINAGPAPALIWANAG na ng Korte Suprema si dating Former National Task Force to End Local Armed Conflict (NTF-Elcac) spokesperson Lorraine Badoy kung bakit hindi siya dapat patawan ng indirect contempt hinggil sa kanyang naging pahayag laban kay Manila Regional Trial Court Judge Marlo Magdoza-Malagar.
Binigyan ng korte si Badoy ng 30 “non-extendible calendar days” si Badoy para ipaliwanag ang apat na bagay para hindi siya ma-contempt.
Ang mga ito ay ang sumusunod:
“If she posted statements attacking the resolution issued by Manila RTC Judge Magdoza-Malagar;
“If her social media post “encouraged more violent language against the judge concerned in any or all of her social media platforms;
“If her post “in the context of social media and in the experience of similar incendiary comments here or abroad, was a clear incitement to produce violent actions against a judge and is likely to produce such act; and
“If her statements on her social media accounts, “implying violence on a judge, is part of her protected constitutional speech.”
Matatandaan na tinawag ni Badoy na “idiot judge” si Magdoza-Malagar matapos nitong ibasura ang petisyon ng gobyerno na ideklarang terorista ang CPP-NPA.
Bukod dito, nagsalita rin si Badoy ng “kung maaaring patayin ang hukom” dapat ay maging lenient din sa kanya ang batas dahil political belief niya ito. Gayunmain, itinanggi ni Badoy na sa kanya ang nasabing post, at tinanggal din sa kanyang account.
