IBINASURA ng Manila Regional Trial Court ang petisyon ng Department of Justice na ideklarang terorista ang Communist Party of the Philippines-New People’s Army (CPP-NPA)
“Nothing is better attested by present realities than that terrorism does not flourish in a healthy, vibrant democracy. WHEREFORE, premises considered, the instant Petition is hereby DISMISSED,” ayon sa desisyon ni Manila RTC Branch 19 Presiding Judge Marlo Magdoza-Malagar na inilabas nitong Setyembre 21.
Pebrero 21, 2018 nang isampa ng DOJ ang proscription case laban sa CPP-NPA base sa Republic Act No. 9372 or human security act as ground.
Isinampa ito bago pa man maisabatas ang anti-terrorism law na pinirmahan ni dating Pangulong Duterte noong 2020 na sinangayunan naman ng Korte Suprema noong 2022.
Sa kanyang ruling, dinismis nito ang petisyon ng DOJ matapos timbangin ang 10-point program ng CPP “which consists of “lofty ideals readily showing that the CPP-NPA is organized or exists, not for the purpose engaging in terrorism.”
