2 probisyon ng Anti-Terror Law unconstitutional

IDINEKLARA ng Korte Suprema ang dalawang probisyon ng Republic Act No. 11479 o Anti-Terrorism Law bilang unconstitutional.

Sa isang desisyon na inilabas ng Public Information Office (PIO) ng Korte Suprema matapos ang isinagawang En Banc session nitong nakaraang Martes, Disyembre 7, sa botong 12-3, idineklara ng SC bilang iiegal ang section 4 ng RA 11479 na nagsasabing “…which are not intended to cause death or serious physical harm to a person, to endanger a person’s life, or to create a serious risk to public safety.”

Samantala, sa botong 9-6, idineklara rin ng SC, ang section 25, na nagsasabing, “Request for designations by other jurisdictions or supranational jurisdictions may be adopted by the ATC after determination that the proposed designee meets the criteria for designation of UNSCR (United Nations Security Council Resolution) No. 1373.”

Idinagdag ng SC-PIO na constitutional naman ang naging desisyon sa iba pang probisyon ng RA 11479.

“The main ponencia (main decision) and the various opinions contain interpretations of some of the provisions declared in these cases as not unconstitutional,” sabi ng SC-PIO.

Umabot sa 37 petisyon ang inihain laban sa Anti-Terrorism Law matapos ipatupad noong Hulyo 18, 2020.
